Terms and Conditions

§ 1 Scope

These Terms and Conditions (T&C) apply to all services and transactions of Mobos e.U., Sarobagasse 25, 2103 Langenzersdorf, Austria (hereinafter "Mobos" or "we").

§ 3 Services

Mobos offers the following services:

§ 4 Contract Formation

Contracts are formed by offer and acceptance. Offers from Mobos are non-binding and subject to change, unless expressly stated otherwise. A contract is only formed through our written confirmation or by beginning service delivery.

§ 5 Prices and Payment Terms

All prices include statutory VAT. Prices may change due to market changes or unforeseen circumstances. Payment is due within 14 days of invoicing, unless otherwise agreed.

§ 6 Service Delivery

Services are provided to the best of our knowledge and belief. Appointments are non-binding unless expressly agreed as binding. No damage claims are granted for delays not attributable to Mobos.

§ 7 Warranty and Liability

Mobos is only liable for damages based on intent or gross negligence. Liability for slight negligence is excluded, unless mandatory legal provisions apply. Warranty is governed by statutory provisions.

§ 8 Right of Withdrawal

Consumers have a right of withdrawal according to statutory provisions. The withdrawal period is 14 days from contract conclusion. For services, the right of withdrawal ends as soon as the service has been completely provided and the consumer has agreed to the provision.

§ 9 Data Protection

Processing of personal data is carried out according to our privacy policy, which is part of these T&C.

§ 10 Final Provisions

Should individual provisions of these T&C be invalid, the validity of the remaining provisions remains unaffected. Austrian law applies excluding the UN Convention on Contracts for the International Sale of Goods. Place of jurisdiction is Vienna, provided the customer is a merchant.

§ 11 Severability Clause

Should individual provisions of these T&C be or become invalid, the validity of the remaining provisions remains unaffected. The statutory provision takes the place of the invalid provision.

§ 12 Changes to T&C

Mobos reserves the right to change these T&C. Changes will be communicated to the customer at least two weeks before they take effect. If the customer does not object within two weeks of notification, the changes are deemed approved.
